§ 94-32. Public hearing required prior to work on designated roadways; preservation and enhancement.

  • (a)

    Prior to any construction or reconstruction by the department of public works, other than routine maintenance, on any of the roadways described in section 94-31, the county council shall hold a public hearing, after due public notice, to determine the nature and extent of any construction or reconstruction to be performed on said scenic roadways by said department. After said public hearing, the county council shall instruct said department as to the manner or method of such construction or reconstruction which is to occur on any of such scenic roadways; provided, however, it is not the intent of this section to preclude good engineering judgment in roadway design. The county council may require the department of public works to mitigate the impact of such construction or reconstruction, by the planting of trees or other vegetation along the right-of-way of said scenic roadway. The county forester shall cooperate with the department in developing the best management practices which may be employed to preserve or enhance said scenic roadway.

    (b)

    The term "due public notice," as used in this section, shall include the day, time, place and purpose of said public hearing, published in a newspaper of general circulation in the county at least 15 days prior to said public hearing, excluding Sundays and legal holidays.
