§ 34-36. Arts selection.

  • (a)

    Board functions. The cultural arts advisory board shall remain as the primary voice of recommendations to the county council. One member of the cultural arts advisory board shall be chosen by the board to sit on each arts selection committee. The process that the art selection committee follows shall be mandated by this article and guided by the cultural arts advisory board.

    (b)

    Selection methods.

    (1)

    Direct selection. This method of selection is permitted only for projects with art allocations of $5,000.00 up to $25,000.00.

    a.

    A committee composed of at least the user agency representative and a member of the cultural arts advisory board, a minimum of one visual arts representative, and the designated program administrator are responsible for making the art selection. After review and approval of the art selection process, the cultural arts advisory board will forward their recommendation to the county council for approval.

    b.

    Recommended acquisitions may be purchased or commissioned works.

    c.

    The selection committee must view the actual artwork on recommended purchases.

    d.

    The selection committee must submit to the county council the artist's resume, declaration and either a slide of the recommended purchase of detailed drawing or a scaled model, narrative and budget for the recommended commissioned work.

    (2)

    Invitational method. This method of selection is permitted only for projects with art allocations between $25,001.00 and $50,000.00.

    a.

    A committee composed of at least the user agency representative, architect, a minimum of one visual arts professional, one member of the cultural arts advisory board, and the designated program administrator is wholly responsible for making the art selection. After review and approval of the art selection process the cultural arts advisory board will forward their recommendation to the county council for approval.

    b.

    Recommended acquisitions may be purchased or commissioned works.

    c.

    The selection committee must view the actual artwork on recommended purchases.

    d.

    The selection committee must submit to the county council the artist's resume, declaration and either a slide of the recommended purchase or a detailed drawing or a scaled model, narrative and budget for the recommended commissioned work.

    e.

    The selection committee must provide for the county council a list of at least three invited artists, a public announcement of the committee's recommendations and display of works, and/or proposals for solicitation of public comment.

    (3)

    Open competition. This method is permitted only for projects with art allocations of $50,001.00 or more.

    a.

    A committee composed of at least the user agency representative, architect, three visual arts professionals, one member of the cultural arts advisory board, and the designated program administrator is wholly responsible for making the art selection. After review and approval of the art selection process, the cultural arts advisory board will forward their recommendation to the county council for approval.

    b.

    Recommended acquisitions may be purchased or commissioned works.

    c.

    The selection committee must view slides of the artist's previously commissioned installed works.

    d.

    The selection committee must submit to the county council the artist's resume, declaration and either a slide of the recommended purchase or a detailed drawing or a scaled model, narrative and budget for the recommended commissioned work.

    e.

    The selection committee must document for the county council the methods used to solicit artists (which must include the mailing list provided by the cultural arts advisory board, public announcement of the committee's recommendations and display of works and/or proposals to solicit public comment).

    (c)

    Responsibilities of user agency representatives. It is the responsibility of the designated user agency representative to consult with those individuals who will be occupying the facility and to respond effectively to their input and concerns.

    (1)

    The project manager shall serve in an advisory capacity to assist with siting, construction schedules, maintenance issues, etc.

    (2)

    Acquisitions recommended for all three categories may be by purchases or commissions.

    (3)

    The visual artist professionals shall be selected by the cultural arts advisory board.

    (4)

    On all projects over $10,000.00, an amount of up to ten percent of the allocation, not to exceed $5,000.00, may be set aside for implementation expenses. Allowable expenses would include advertising, artist travel, postage, shipping and insurance for existing works sent to the site for consideration, and a publication to announce the artwork dedication ceremony. The proper method for approval of these expenditures must be from the county department of finance and sought by the user agency representative.

    (d)

    Art selection committee members. These definitions should provide a guideline to the selection of the arts selection committee.

    (1)

    User agency representative. This individual should be the equivalent of an administrative head of the user agency, or his designee, who will act on behalf of the specific agency or division of the county involved.

    (2)

    Architect. This individual is the architect for the specific building involved at the time.

    (3)

    Visual arts professional. This individual is a person selected by the cultural arts advisory board for his expertise or involvement in a particular form of art relevant to the specific project.

    (4)

    Member of the cultural arts advisory board. This individual is one of the members of the cultural arts advisory board. The cultural arts advisory board will choose the member who will serve. This should be a rotating duty.

    (5)

    Program administrator. This individual is the coordinator or contact person for the project from the county manager's office.
