§ 2-113. Departments and divisions.

  • (a)

    There is hereby created the aviation and economic resources department. The head of the department shall be the director. The department shall consist of the following divisions:

    (1)

    Airport: There is hereby created the airport division. The head of the airport division shall be the director and shall report to the department director. The division shall carry out the policies of the county on all matters affecting airport facilities under the control of the county and shall make necessary management decisions within the framework of those policies.

    (2)

    Economic development: There is hereby created the economic development division. The head of the division shall be the director and shall report to the department director. The division shall be responsible for promoting the economic development and expansion of the tax base within the county by encouraging and assisting new and existing businesses and industry to invest new capital and to create new opportunities for employment within the county.

    (b)

    There is hereby created the growth and resource management department. The head of the growth and resources management department shall be the director. Within this growth and resource management department are created the following divisions:

    (1)

    Environmental management: There is hereby created environmental management. The head of environmental management shall be the director. Environmental management shall be responsible for both regulatory and nonregulatory activities dealing with natural resources and pollution control programs.

    (2)

    Planning and development services: There is hereby created planning and development services. The head of planning and development services shall be the director.

    Planning and development services shall be responsible for the coordination of all county functions in the area of comprehensive planning, land development, development engineering and concurrency management.

    (3)

    Building and zoning code administration: There is hereby created building and zoning code administration. The head of building and zoning code administration shall be the director.

    The building and zoning code administration division shall be responsible for building permits and inspections, zoning, impact fees, code enforcement and contractor regulation.

    (4)

    Land acquisition and management: There is hereby created land acquisition and management. The head of land acquisition and management shall be the director. Land acquisition and management shall be responsible for administering and implementing the Volusia Forever Program, and purchasing and managing county lands as determined by the county manager.

    (c)

    There is hereby created the public protection department. The head of the public protection department shall be the director. Within this public protection department are created the following divisions:

    (1)

    Animal control: There is hereby created animal control. The head of animal control shall be the director.

    Animal control shall be responsible for the enforcement of the County of Volusia Code, chapter 14 and the provisions of state law, rules and regulations relating to animal control in the unincorporated area of the county. More specifically, the licensure of animals, control of animals, or seizure and impoundment of animals. Animal control shall also be responsible for the investigation and enforcement of state statutes that relate to animals.

    (2)

    Beach safety: There is hereby created beach safety. The head of beach safety shall be the director. Duties and responsibilities of the beach safety division director shall be those of the beach director as provided in chapter 20 of this Code.

    (3)

    Corrections: There is hereby created corrections. The head of corrections shall be the director.

    Corrections shall be responsible for the exercise of administrative supervision and control of all functions, duties and responsibilities over all matters relating to the county correctional facility and the county branch jail. Corrections shall also be responsible for and shall exercise the administrative supervision and control over all programs and services consistent with laws and ordinances operating within correctional facilities.

    (4)

    Emergency management: There is hereby created emergency management. The head of emergency management shall be the director. Emergency management shall be responsible for the organization, administration and operation of emergency management activities, services and programs throughout the county that enable mitigation, preparation, response and recovery from any natural, manmade or technological disasters in the county.

    (5)

    Fire services: There is hereby created fire services. The head of fire services shall be the director. Fire services shall be responsible for the coordination and administration of county functions in the area of fire suppression and control, fire prevention through enforcement of applicable fire safety codes.

    (6)

    Medical examiner: Pursuant to F.S. § 406.17, there is hereby created the medical examiner. The head of medical examiner shall be the medical examiner, who shall be a practicing physician in pathology. Said medical examiner shall also serve as the district medical examiner as provided in F.S. § 406.17 and shall have the duties and responsibilities as provided in F.S. ch. 406.

    (7)

    Emergency medical administration: There is hereby created emergency medical administration. The head of emergency medical administration shall be the director. Emergency medical administration shall be responsible for the organization, administration and operation of emergency medical activities, services and programs throughout the county as more fully set forth in section 46-85 of this Code.

    (8)

    Emergency medical services: There is hereby created emergency medical services. The head of emergency medical services shall be the director. The emergency medical services division shall generally provide emergency medical services and ground transportation as specified in article VI, chapter 46 of this Code.

    (d)

    There is hereby created the community services department. The head of the community services department shall be the director. Within this community services department are created the following divisions:

    (1)

    Community assistance: There is hereby created community assistance. The head of community assistance shall be the director. The primary function of community assistance shall be to coordinate and develop the various community services between the various federal, state and local agencies and the citizens of the county for more efficient utilization and delivery of community services' resources.

    (2)

    Cooperative extension service: The head of the University of Florida Cooperative Extension Service shall be the county extension director who shall be assigned by the University of Florida, Institute of Food and Agricultural Science, who shall be a faculty member of the university. The University of Florida Cooperative Extension Service shall be responsible for informal, noncredit education conducted beyond the formal classroom for all ages. Such education is to be practical, problem centered and situation based. The county extension director shall be responsible for planning, assigning and coordinating the program of the University of Florida Cooperative Extension Service in the county and shall perform related duties as required.

    (3)

    Library services: There is hereby created library services. The head of library services shall be the director. Library services shall collect, organize and provide a quality selection of books and other materials; employ an expert staff and maintain facilities in which services are provided; and provide a free public library service to all residents of the county.

    (4)

    Veterans services: There is hereby created veterans services. The head of the veterans services shall be the veterans service officer. Veterans services shall assist veterans, widows, children and other veterans dependents in the filing of claims and providing of information for any veteran benefits to which they may be entitled.

    (5)

    VOTRAN: There is hereby created VOTRAN mass transit service. The head of the VOTRAN mass transit service shall be the general manager.

    VOTRAN mass transit service shall carry out the policy and authority on all matters affecting public transportation under control of this authority and shall make necessary management decisions within the framework of those policies.

    (6)

    Parks, recreation and culture: There is hereby created the division of parks, recreation and culture. The head of parks, recreation and culture shall be the director.

    Parks, recreation and culture shall be responsible for developing recreational programs, for fostering public awareness for county history and the arts, for developing recreational park facilities, for developing programs in support of cultural and historical activities, and for maintaining county parks and the grounds surrounding specified county-owned buildings. Recreation and educational programs shall be designed to encourage usage and awareness of county recreational and cultural assets by people of differing ages and interests.

    (e)

    There is hereby created the public works department. The head of the public works department shall be the director. Within this public works department are created the following divisions:

    (1)

    Coastal: There is hereby created the coastal division. The head of the coastal division shall be the director and shall report to the department director. The division shall be responsible for all functions and duties of the Ponce DeLeon Inlet and Port District, and shall have the responsibility for coastal programs, and construction projects assigned by the department director.

    (2)

    Engineering: There is hereby created engineering. The head of engineering shall be the county engineer.

    Engineering shall be responsible for the design, surveying, inspection, permitting and review of development plans for the construction of county roadways or highways and other county projects.

    (3)

    Mosquito control: There is hereby created mosquito control. The head of mosquito control shall be the director.

    Mosquito control shall be responsible for control and abatement of mosquitoes and aquatic weeds, marsh management and public education concerning mosquito borne diseases and prevention thereof.

    (4)

    Road maintenance: There is hereby created road maintenance. The head of road maintenance shall be the director.

    Road maintenance shall be responsible for maintaining and upgrading the existing transportation system throughout the county including roads, highways, bridges and related projects.

    (5)

    Solid waste: There is hereby created solid waste. The head of solid waste shall be the director.

    Solid waste shall be responsible for providing facilities for disposal of solid waste, and providing for collection, implementation of recycling programs and enforcement of litter laws and other related laws and ordinances.

    (6)

    Traffic engineering: There is hereby created traffic engineering. The head of traffic engineering shall be the director.

    Traffic engineering shall be responsible for providing and enhancing motoring safety through design, construction and maintenance of traffic control signs, signals and roadway pavement markings.

    (7)

    Water resources and utilities: There is hereby created water resources and utilities. The head of water resources and utilities shall be the director. Water resources and utilities shall be responsible for providing water and wastewater treatment, utility operations, engineering and stormwater utility management.

    (f)

    There is hereby created the finance department. The head of the department shall be the chief financial officer who shall also perform the duties of the finance director wherever that position is referred to in the Charter and this Code. The finance department shall be responsible for overseeing all financial matters pertaining to the county and shall provide a comprehensive financial management system which properly accounts for all the financial transactions of the county. Within this finance department are created the following divisions:

    (1)

    Accounting: There is hereby created accounting. The head of accounting shall be the director. Accounting shall be responsible for all functions prescribed by Florida Statutes for the office of clerk of the circuit court acting as auditor to the board of county commissioners, as provided in subsection 601.1(1)b of the Charter of Volusia County.

    (2)

    Human resources: There is hereby created human resources, as described in the merit system and sections 1004.1 and 1004.2 of the Charter. The head of human resources shall be the director. Human resources shall be responsible for risk management, the administration and implementation of the county merit system, including its recruitment and development of employees, and provide equal opportunity.

    (g)

    There is hereby created the Ocean Center department. The head of the department shall be the director. The Ocean Center shall administer and maintain the center to ensure the facilities are used to their fullest potential by conventions, sports, family, civic, commercial and entertainment groups to provide a wide array of activities to the citizens and visitors of the county.

    (h)

    There is hereby created the budget and administrative services department. The head of the department shall be the director. The budget and administrative services department shall be responsible for overseeing budgetary and administrative matters pertaining to the county, including the procurement of goods and services. Within this budget and administrative services department are created the following divisions:

    (1)

    Management and budget: There is hereby created management and budget. The head of management and budget shall be the director. Management and budget shall be responsible for the development of an annual budget and grants document, and administering the annual value adjustment board. Management and budget shall also conduct research to assist in the review of departmental programs for effectiveness and efficiency.

    (2)

    Purchasing. There is hereby created purchasing. The head of purchasing shall be the director. Purchasing shall be responsible for managing the county's resources through the procurement and management of materials and services.

    (i)

    There is hereby created the business services department. The head of the department shall be the director. The business services department shall be responsible for overseeing the county's collection of revenue, facilities and fleet management, and information technology resources. Within this business services department are created the following divisions:

    (1)

    Central services: There is hereby created central services. The head of the central services shall be the director. Central services shall be responsible for the safe maintenance and cleanliness of designated county facilities. It shall also be responsible for leasing space and contracts administration, including without limitation janitorial, courier and security, services. It shall also be responsible for establishing space and construction standards, space allocation, renovations and design and construction projects assigned by the county manager. Central services shall also be responsible for providing fleet vehicles, fleet maintenance services, administering the lease/rental program, and providing fuel for county vehicles.

    (2)

    Information technology: There is hereby created information technology. The head of information technology shall be the director. Information technology shall be responsible for all aspects of information and communications technology, including direction of standards for procurement, implementation and maintenance of hardware and software.

    (3)

    Revenue: There is hereby created revenue. The head of revenue shall be the director. Revenue shall be responsible for all functions prescribed by Florida Statutes for the office of tax collector. In addition, the county may contract with a privately owned auto tag agency to act as an agent for the County of Volusia in the performance of the county's duties and responsibilities relating to the processing of the State of Florida, Division of Motor Vehicles, title and registration applications for the public and the collection of sales tax for the same.

    (j)

    There is hereby created the internal auditing department. The head of the department shall be the director. The department of internal auditing shall be responsible for performing audits in accordance with professional standards for internal auditing. The internal auditing department shall have authority to conduct audits of all departments, offices, boards, agencies, contracts, grants, and any other operation or program under the direction or responsibility of the county council, including functions for which the county council provides financial support. The department of internal auditing shall solicit input from the county council and county manager to develop an annual audit plan which shall be submitted to the county council for approval. All completed and final audit reports developed pursuant to the audit plan shall be submitted simultaneously to the county council and county manager. Audits shall include, but are not limited to, operational, compliance, and forensic audits. The department of internal auditing is authorized to engage in other related activities, including, but not limited to, review of rules, regulations, policies, procedures, controls, and transactions; monitor implementation of recommendations made and corrective actions taken; coordinate the department's activities with the external auditors; and investigate occurrence of alleged fraud, abuse, or illegal acts.
