§ 214-67. Additional filing fees; appropriation.

  • There shall be taxed and collected by the clerk of the circuit court of Volusia County, Florida, as authorized by F.S. § 28.241, or as otherwise authorized by law, the sum of $4.00 as costs of all parties instituting any civil action, suit or proceeding in the circuit court of Volusia County, Florida. The clerk of the circuit court of Volusia County, Florida, shall not receive and file any civil action, suit or proceeding in his office as clerk, until and unless the sum of $4.00 is paid to him as costs, as provided in this section; provided that the $4.00 as costs shall not be collected by the clerk in civil actions, suits and proceedings, which, under the Laws of Florida, do not require parties to pay any costs whatsoever when instituting such civil actions, suits or proceedings. That the $4.00 so taxed and collected in civil actions shall be in addition to the costs otherwise provided by law for the institution of civil actions, suits, or proceedings in the circuit court. All monies collected by the clerk shall be set aside and paid monthly to the treasurer of the board of trustees of Volusia County law libraries to the accounts provided by the terms of this act [article] and as designated by the board.
