§ 90-75. Findings, purpose and intent.

  • In adopting this article, the county council makes and expresses the following findings, purpose and intent:

    (1)

    In accordance with section 206 of the Charter, the 2005-2006 Charter review commission was formed to prepare the necessary amendments to the Charter for consideration by the voters of Volusia County.

    (2)

    On April 25, 2006, the school board recommended to the Charter review commission that it prepare an amendment to the Charter which required the county council to provide by county-wide ordinance that county and municipal comprehensive plan amendments and rezonings allowing increased residential density be effective only if adequate public schools could be timely planned and constructed to serve the projected increase in student population.

    (3)

    As a result of information, evidence and testimony received at public meetings and recommendation by the school board, the Charter review commission proposed the creation of section 206 of the Charter.

    (4)

    The citizens of the county voted at a referendum held on November 7, 2006, to adopt the Charter amendment which created section 206 of the Charter.
