§ 90-42. Waiting period for reapplication for certificate.

No unit of local government shall have the right to file an application for certification
pursuant to section 90-35 if the same plan, element, or plan amendment for which certification is applied has
been the subject of an application before the commission within a period of six months
prior to the filing of the application. However, the applicant jurisdiction has the
right to withdraw, without the penalty of the six-month waiting period, an application
at any time up to 15 days before either: (i) the issuance of a letter of certificate
of plan consistency pursuant to subsection 90-37(i); or (ii) the date of the scheduled public hearing on the application pursuant
to subsection 90-35(e). Such withdrawal of the application shall be made either electronically or in
writing and delivered by hand delivery, U.S. Mail or courier service to the commission.
Electronic transmissions must be followed up by the applicant jurisdiction with a
hard copy transmittal delivered to the commission as soon as possible.
