§ 86-369. Involuntary demotions.
(a)
When it has been determined that an employee is unable to satisfactorily perform the duties of a position, the appointing authority may demote an employee to a position in a lower class having duties and responsibilities which the employee can successfully perform.
(b)
Involuntary demotions shall be made in accordance with the procedures in division 13 of this article.
(c)
When demotion is involuntary, the employee's pay rate shall be determined by the human resources director, but shall be no higher than the previous pay rate, or the maximum pay rate for the new class, whichever is lower.
