§ 82-60. Facilities, structures, and equipment.
(a)
Constructing or erecting any permanent facility or structure (including fencing) is prohibited on all conservation lands unless authorized by a lease, contract with the county, or special use.
(b)
Unauthorized facilities or structures located on conservation lands shall be processed according to the following procedure:
(1)
Upon discovery of an unauthorized facility or structure, the division shall post a notice on such facility or structure for a period of five days informing the owner that such facility or structure is not authorized and that the owner must remove such facility or structure. The division shall also mail notice, by certified mail, to the owner, if known, of the unauthorized facility or structure. Said mailing shall occur on the date upon which notice was posted upon the unauthorized facility or structure.
(2)
The owner of an unauthorized facility or structure shall remove such facility or structure within five days after the posting and mailing, if performed, of the notice.
(3)
If the owner of the unauthorized facility or structure fails to remove such facility or structure within five days after posting and mailing, if performed, of the notice, the division shall remove such facility or structure from the conservation land or claim such facility or structure as county property.
(c)
The unauthorized destruction, removal, or alteration of any county owned structures, facilities, or equipment is prohibited on all conservation lands.
