§ 78-2. Dumping in channel, basin or other drainageway.

  • (a)

    Prohibited. No person shall throw, place or cause to be placed, any refuse, paper, trash, glass, nails, tacks, wire, bottles, cans, yard trash, concrete, earthen fill, garbage, containers, litter or any other debris or material of any kind and nature in any public subsurface drain, channel, canal, ditch, swale, stream, river, retention basin or other drainageway that regularly or periodically carries surface water runoff. Any person who places or causes to be placed any of such items shall remove it or shall cause it to be removed therefrom immediately.

    (b)

    Jurisdiction. The jurisdiction encompassed by this section is all of the unincorporated areas of the county.

    (c)

    Penalty; additional remedies. Violation of the provisions of this section or failure to comply with any of its requirements or lawful order of the county council or the code enforcement officer shall be punished in accordance with section 1-7. In addition to any other remedies, whether civil or criminal, the violation of this section or any lawful order of the county council or the code enforcement officer may be otherwise abated in any manner provided by law.
