§ 72-501. Administration.

  • (a)

    Purpose. The purpose of this section is to set out the various administrative procedures of this article and to provide for the establishment of the development review committee, the land development manager, and the land development division.

    (b)

    Development review committee.

    (1)

    Established. There is hereby established a development review committee (DRC).

    (2)

    Membership. Membership of the DRC shall include the following, or their designated representative:

    a.

    Director of the growth and resource management department who shall act as chair;

    b.

    Two additional members who shall be appointed by the county manager.

    Other county, local, state or federal agencies may be consulted by the DRC for advice or recommendations on any matter or application being considered by the DRC.

    (3)

    Duties and responsibilities. The duties and responsibilities of the DRC shall include:

    a.

    Reviewing all applications under this article to:

    1.

    Delineate areas of noncompliance with county development requirements; and

    2.

    Define steps necessary to bring applications into compliance with county development requirements.

    b.

    Approving applications for development orders.

    c.

    When, in the judgment of the DRC, strict application of the requirements of this article would result in an inequitable or unreasonable result, stifle innovative or creative design, or create undue hardship when applied to a specific project or development, or as set forth in sections 72-1306 and 72-1312, the DRC may modify such requirements to the extent necessary to achieve equity or reasonableness, or relieve the undue hardship; provided that no such modification shall be contrary to requirements of law or the general policies of this article; nor shall any such modification as applied to one development, establish precedent with regard to any other development subject to review. Application for such modification may be submitted with the development review application at any phase of the review process.

    d.

    Performing such additional duties as the county manager may, from time to time, assign.

    (4)

    Meetings. The DRC shall meet at least twice per month at such place as determined by the DRC. A schedule of the meeting times and places shall be adopted annually by the DRC. An agenda shall be prepared and distributed to each member and to the applicant at least five working days prior to each meeting. All applicants having requests to be reviewed by the DRC shall be invited to attend and participate in the meeting. Such records of the proceedings of the DRC meetings as required by law shall be kept.

    (c)

    Land development manager.

    (1)

    Position established and appointment. The position of land development manager (LDM) is hereby established within the County of Volusia. The LDM shall be appointed in a manner consistent with the Volusia County Charter.

    (2)

    Duties and responsibilities. The duties and responsibilities of the LDM shall include:

    a.

    Coordinating application review procedures;

    b.

    Issuing concurrency certificates of capacity;

    c.

    Administration and management of the land development division;

    d.

    Issuing development orders and development permits in compliance with the requirements and procedures of this article;

    e.

    Filing final subdivision plats with the clerk of the circuit court;

    f.

    Ensuring that final construction plans and final plats are consistent with approved development orders;

    g.

    Performing such additional duties as the county manager, the director of the growth and resource management department and/or the planning and development services director may assign.

    (d)

    Land development division.

    (1)

    Established. There is hereby established a land development division (LDD) within the County of Volusia.

    (2)

    Duties and responsibilities. The duties of the land development division shall include:

    a.

    Being a central intake point for applications;

    b.

    Reviewing applications for completeness;

    c.

    Providing liaison between applicants and the DRC;

    d.

    Preparing and distributing agendas and reports for meetings of the DRC and the county council;

    e.

    Taking and preparing the minutes of all DRC meetings;

    f.

    Comparing final construction plans and final plats with the approved development order to ensure consistency;

    g.

    Performing such other functions as the county manager, the director of the growth and resource management department, the planning and development services director and/or land development manager may, from time to time, assign.
