§ 72-964. Hazardous substances regulated.

  • (a)

    The hazardous substances regulated by this division shall consist of the following:

    (1)

    Chapter 38F-41 of the Florida Administrative Code (the Florida Substance List, adopted June 10, 1985).

    (2)

    Title 40 of the Code of Federal Regulations Part 261 (Identification and Listing of Hazardous Wastes, adopted May 19, 1980).

    (3)

    Title 40 of the Code of Federal Regulations Part 302.4 (Table 302.4) (List of Hazardous Substances and Reportable Quantities, adopted April 4, 1985, amended September 13, 1988, and May 24, 1989).

    (4)

    Title 40 of the Code of Federal Regulations Part 355, Appendix A and B (List of Extremely Hazardous Substances, adopted April 22, 1987, amended December 17, 1987, and February 25, 1988).

    (b)

    A hazardous substance, as defined herein, includes any solution, mixture, or formulation containing such materials, and also includes any material which, due to its chemical or physical characteristics, as determined by the enforcement official upon the advise [advice] of the EMD which poses a substantial threat to the life, health, or safety of persons or property or to the environment.
