Division 13. POTABLE WATER WELL FIELD PROTECTION |
§ 72-962. Establishment of well field protection zones.
The regulations set forth in this division shall apply to all lands surrounding a potable water supply well designated as the primary or secondary well field protection zone(s) as defined in section 72-2.
(1)
Mapping. The environmental management director (EMD) shall provide well field protection zone maps to designate and geographically delineate and amend, as necessary, the primary and secondary well field protection zones as defined in section 72-2. Said maps shall be on file with the environmental management department.
(2)
Interpretation of zone designation. To determine the location of properties and buildings within the primary or secondary well field protection zones, the following rules shall apply:
a.
Properties located wholly within one protection zone shall be governed by the restrictions applicable to that zone.
b.
Properties having parts lying within more than one zone shall be governed by the restrictions applicable to the protection zone in which each part of the property is located.
c.
Where the boundary between two protection zones passes through a building, the entire building shall be considered to be in the more restrictive zone.
d.
Where the building or portion thereof is overlapped by protection zones of different wells or well fields, the most restrictive regulations shall apply.
e.
Where a property or portion thereof is overlapped by protection zones of different wells or well fields, the most restrictive of the regulations shall prevail over said overlapped area.
