§ 70-175. Methodology for calculating the impact fee.

(a)

The school board by rule may establish a fee determination methodology and the fee or a fee schedule. The rule shall provide an effective date for any fee at least 90 days after adoption. A fee shall be based on the most recent and localized data and consistent with the level of service provided in the county comprehensive plan. The school board shall find that the feepayer does not bear more than a lawful share of the capital cost for which the fee is collected.

(b)

No adjustment shall be made for 2008 or subsequent years. The county shall refund amounts paid which exceed the 2007 fee amount by reason of the automatic adjustment for 2008 formerly provided in effect.
