§ 54-72. Adoption of Standard Fire Prevention Code and Life Safety Code.

  • (a)

    Standard Fire Prevention Code adopted. The Standard Fire Prevention Code, 1994 edition, a copy of which is on file in the office of the county council, Thomas C. Kelly Administration Center, in the City of DeLand, Florida, is hereby adopted and by reference made a part of this article, as if set forth in extenso, as the Standard Fire Prevention Code for the county, outside the corporate limits of all cities and towns therein.

    (b)

    Life Safety Code adopted. The Life Safety Code, 1994 edition, a copy of which is on file in the office of the county council, Thomas C. Kelly Administration Center, in the City of DeLand, Florida, is hereby adopted and by reference made a part of this article, as if set forth in extenso, as the Life Safety Code for the county, outside the corporate limits of all cities and towns therein.

    (c)

    Fees. Fees for permits and other related charges shall be set by resolution of the county council after due public notice and hearing thereon.

    (d)

    Appeals. Any decision of the fire official pertaining to these codes may be appealed to the building code board of adjustments and appeals pursuant to the Standard Building Code, sections 5, 105 and A105.4. The member of the board from the publicsector shall be replaced by an individual with expertise in fire safety standards for an appeal from the Life Safety Code only.

    (e)

    Conflicts between adopted codes. In the event the building official and fire official are unable to agree on a resolution of a conflict between the Standard Building Code and the Life Safety Code, the building code board of adjustments and appeals shall resolve the conflict in favor of the code which offers the greatest degree of life safety or alternatives which would provide an equivalent degree of life safety and an equivalent method of construction.

    (f)

    Conflicts with state or county regulations. In the event of any conflict between this article, the adopted codes of the county, and any applicable state or county law, ordinance, rule or regulation, the more stringent shall apply.
