§ 54-35. Discharge of fireworks.

  • (a)

    Authority. The director may prohibit the discharge of a firework by any person or entity within the unified fire rescue district, established by this chapter, for the purpose of preventing wild fires during drought conditions. Determination that drought conditions warrant the order shall include consideration of drought index indicators, rainfall deficit, wind conditions, dry or dead vegetation or other meteorological conditions which increase the risk of wildfire as defined by F.S. § 590.01.

    (b)

    Order. The prohibition shall be rendered by written order and have effect for no more than 60 days, which may be extended for no more than 60 additional days. Further extensions may be granted by ordinance of the county council. The order shall make provision for early termination by the director upon determination that drought conditions and the threat of wildfire have been sufficiently alleviated through rainfall or other meteorological conditions. The order shall be final and non-appealable.

    (c)

    Firework, defined. For purposes of this section, the term "firework" means any combustible or explosive composition or substance or combination of substances or any article prepared for the purpose of producing a visible or audible effect by combustion, explosion, deflagration, or detonation. This term includes, but is not limited to, blank cartridges and toy cannons in which explosives are used, the type of balloons which require fire underneath to propel them, firecrackers, torpedoes, bottle rockets, skyrockets, roman candles, aerial bombs, sparklers, snake or glow worms, trick noise makers, snappers, trick matches and any fireworks containing any explosives or flammable compound or any tablets or other device containing any explosive substance.

    (d)

    Violations. Discharge prohibited by an order authorized by this section shall constitute a violation punishable pursuant to section 1-7 of the Code. Each discharge shall be considered a separate violation.
