Notwithstanding the provisions of any local government's stormwater management ordinance
or provision of division 2 of this article in effect, individual single-family and
duplex residential dwellings, not included in a stormwater management plan, shall
provide a volume of retention equivalent to one-half inch of depth over the entire
site or lot. Prior to the issuance of a building permit, an application shall be submitted
to the local government for review. Said local government may approve, modify or deny
the application. An appeal of a denial may be provided for by the local government.
