§ 50-35. Pollution control code.
(a)
The county pollution control code, also called the "pollution control code" and the "local code," shall consist of selected rules of the state department of environmental protection. The county council shall adopt, by ordinance, those rules of the state department of environmental protection which the council desires the board to enforce as the pollution control code. Subsection (b) of this section specifies those state rules adopted by reference as part of the local code. This section need only specify the number and title of the state rule in order for the rule to be adopted, by reference, as part of the local code. Subsequent amendments to the state rules made by the environmental regulation commission, to any rule adopted by reference by the county council, shall automatically be incorporated into the pollution control code. This provision will ensure that the local code will always remain consistent with state rules. The pollution control code shall be maintained by the environmental control officer and be on file in the environmental control division office. Any reference in the pollution control code to the environmental regulation commission shall mean the pollution control board, any reference to the department of environmental protection shall mean the environmental control division, and any reference to the secretary shall mean the environmental control officer.
(b)
The county council hereby adopts, by reference, the following rules of the state department of environmental protection, to compose the pollution control code of the county:
