§ 46-143. Quorum; power and authority.

  • If a quorum of the county council is unable to meet for such purpose, the chair shall have the power and authority to request state assistance or invoke emergency-related mutual aid assistance by declaring a state of local emergency in the event of an emergency affecting the county. By law the duration of such state of local emergency is limited to seven days; however, it may be extended, as necessary, in seven-day increments. In the event that the chair is unavailable during an emergency situation, then the vice-chair shall assume the authority and responsibilities of the chair. In the event that both the chair and vice-chair are unavailable during such an emergency situation, then any available member of the county council, beginning with the county council member who has served for the longest continual period, shall assume said authority and responsibilities. Precedence shall be given between council members with equal terms of service to that council member whose surname begins with the earlier letter in the alphabet. In the event that all of the county council members are unavailable during such an emergency situation, then the authority and responsibilities of the chair shall be exercised and discharged by the county manager or designee. The individual occupying the position of interim chair shall exercise the powers and discharge the duties of the position until such time as a preceding named official becomes available to exercise the powers and discharge the duties of interim chair.
