§ 30-55. Renewal.
(a)
Commencement of proceedings. During the six-month period which begins with the 36th month before the expiration of the term of a franchise, the county may on its own initiative, and shall at the request of a cable operator under a franchise, commence proceedings which afford the public in the service area of the franchise appropriate notice and participation for the purposes of:
(1)
Identifying the future cable-related community needs and interests; and
(2)
Reviewing the performance of the cable operator under the franchise during the then-current franchise term.
(b)
Submission of renewal proposals. Upon completion of a proceeding under subsection (a) of this section, the cable operator seeking a renewal of a franchise may submit a proposal for renewal. The proposal shall contain such information as the county may reasonably require (including proposals for an upgrade of the cable system), and it shall be submitted by a date to be established by the county.
(c)
Review procedures. Upon submittal to the county of a proposal of renewal, the county and the cable operator shall proceed in accordance with the procedures and requirements of the Cable Communications Policy Act of 1984, 47 USC 546, as amended by the Cable Television Consumer Protection and Competition Act of 1992.
