§ 30-42. Prerequisites.

Latest version.

No grant of an initial franchise, no grant of a geographic expansion of an existing franchise, and no transfer of a franchise shall be approved and no other material modification of any franchise (except as otherwise prescribed in the Cable Communications Policy Act of 1984, 47 USC 545, as amended by the Cable Television Consumer Protection and Competition Act of 1992) shall be made authorized or approved until the following minimum conditions are satisfied:
(1)

The applicant has submitted an application in accordance with this chapter;

(2)

A duly advertised public hearing has been held by the county council on the application in accordance with this chapter;

(3)

The county council has made the decision required in section 30-45(5); and

(4)

The applicant has complied with all of the other provisions of this chapter.
