§ 30-6. Authority of county to regulate cable systems.

  • (a)

    To the extent consistent with the Cable Communications Policy Act of 1984, as amended by the Cable Television Consumer Protection and Competition Act of 1992, and not preempted by rule, actions or policy of the FCC, with the Communications Act of 1934, or with other federal or state laws, the county shall have continuing regulatory jurisdiction over the operation of any franchise, cable system or cable operator in the unincorporated portions of the county and shall have the authority to adopt, in addition to the provisions of this chapter and any franchise, such additional regulations as the county may find necessary in the exercise of its police power.

    (b)

    The county council shall regulate rates, and adopt, enforce and comply with the rules and regulations of the FCC Cable Television Consumer Protection and Competition Act of 1992, including but not limited to the public hearing process.
