§ 2-243. Acquisition of land.

  • (a)

    Making or accepting offer in excess of fair market value prohibited. Pursuant to the county land acquisition plan, the county council is hereby prohibited from making or accepting an offer for the acquisition of a parcel of property under the county land acquisition plan in excess of the fair market value of the property established by the county property appraiser or by an appraiser selected by the county.

    (b)

    Exceptions. The county council may jointly participate with other governmental or private agencies and make or accept an offer for the acquisition of a parcel of property under the county land acquisition plan in excess of the fair market value provided that the contribution of the county does not exceed the fair market value of the property established by the county property appraiser or an appraiser selected by the county. Such other governmental agencies shall not include any entity or district for which the county council shall serve as the governing body, or shall have the right of approval of members of the governing body, or shall have provided a grant or contribution for the same acquisition.

    (c)

    Penalty. Violations of this section are punishable as provided in section 1-7.
