§ 26-33. Purpose and intent; jurisdiction.

  • The provisions of this article are based upon evidence and testimony related to the protection of the public health, safety and welfare; to be in the public interest and to make reasonable distinctions between the various forms of businesses, stores and operations either affected or not affected by this article and the hours of operation of those businesses, stores or operations. Late-night business establishments which stay open between the hours of 10:00 p.m. and 5:00 a.m. are more likely to be robbed because they are frequently the only establishments open during those hours, and, due to the nature of the business, cash must be kept on the premises. In order to reduce the incidence of lost property, injury or loss of life due to robbery, the county council finds it necessary to enact this article to protect the public health, safety and welfare. This article shall apply to both the incorporated and unincorporated areas of the county, unless there is a conflict with any existing municipal code under section 26-32.
