§ 20-290.5. Exemption.

  • A person who obtains a license agreement from the county for valuable consideration to use a delineated, fixed and exclusive location on the beach for a temporary or long-term duration shall be exempt from the requirements of sections 20-291 and 20-292 upon the following conditions:

    (1)

    The location shall be separated from the general public by a structure such as a vehicle, kiosk, booth or by fencing, ropes, partitions or other barriers.

    (2)

    The public is given open and obvious notice that commercial activity is being conducted through such measures as prominent signage identifying the products or service for which the solicitation is being conducted and signs at each customer entrance or approach in two-inch block letters of contrasting colors placed three to four feet above grade stating "Commercial Solicitation".

    (3)

    The solicitors do not engage in any solicitation outside the delineated location and the license agreement provides substantial penalties for violation of this restriction.

    (4)

    All solicitation within the fixed location be conducted in compliance with section 20-296.

    (5)

    Each solicitor shall wear a clearly readable nametag on the front of the outerwear above the armpit.
