§ 20-123. Breach of the peace; disorderly conduct.

  • No person on the beach or an approach shall commit such acts as are of a nature to corrupt the public morals, or outrage the sense of public decency, or affect the peace and quiet of persons who may witness them, or engage in brawling or fighting, or engage in such conduct as to constitute a breach of the peace or disorderly conduct, including:

    (1)

    Any act or language constituting an express or implied threat of injury to any person or of damage to or loss of any property owned by or in lawful possession of a person; or

    (2)

    Using profane, abusive or personally threatening language or making any statement, taking any action, or making any gesture or other communication which would cause a reasonable person to be fearful that they would be subjected to an unwanted physical touching or harm to their person or their personal property; or

    (3)

    Intentionally touching a person without the person's consent; or

    (4)

    Any act intended to impede the passage or free movement of a person. Passage or free movement applies to persons on foot or bicycles, in wheelchairs or operating motor vehicles or persons attempting to enter or exit motor vehicles or building.
