Article II. DAYTONA BEACH INTERNATIONAL AIRPORT |
Division 1. GENERALLY |
§ 18-34. Operating rules and regulations.
(a)
All users of and persons on the Daytona Beach International Airport shall be governed by these regulations and the directions of the airport manager:
(1)
General rules.
a.
The airport manager or his authorized representative may suspend, restrict or otherwise regulate all operations without regard to weather conditions when such action is deemed necessary.
b.
These regulations are not intended to amend, modify or supersede any provision of federal, state or local law, all of which must be observed in addition to the regulations contained in this section. All aeronautical activities at this airport and all flying or aircraft departing from or arriving in the airspace above this airport shall be conducted in conformity with the current pertinent regulations and directives of the Federal Aviation Agency and Civil Aeronautics Board and, to the extent applicable, with orders issued by the manager.
c.
All flight instructors shall fully acquaint their students with these regulations and shall be responsible for the conduct of students under their direction during dual instruction. When a student is flying solo, it shall be his responsibility to observe and abide by these rules.
d.
The airport manager may remove or eject from the airport premises any person in violation of these regulations or instructions issued by the manager, may deny the use of the airport to any such person if he determines that such denial is necessary under the circumstances, and may take such other measures as may be permitted by law to enforce airport regulations and maintain the county's control of the airport.
e.
The county assumes no responsibility for loss, injury or damage to persons or property by reason of fire, theft, vandalism, wind, flood, earthquake, collision, strikes or acts of God or of a public enemy, nor does it assume any liability for injuries to persons while on the airport or while using the facilities of same or for property damage.
f.
All persons involved in any accident, personal, aircraft or automotive, occurring on the airport, shall make a full report to the manager as soon after the accident as possible.
g.
No carrier for hire shall load or unload passengers at the airport at any place other than that designated by the manager, nor shall such carrier accept business originating at the airport without a contract with the county or without express approval of the manager.
h.
Payment for use of airport facilities, storage, repairs, supplies or other services rendered at the airport shall be made before airport use permission for removal of aircraft will be granted, unless satisfactory credit arrangements have been made with the manager or the tenant directly responsible for furnishing the commodity or service rendered.
i.
All disabled aircraft and parts thereof on the airport shall be promptly removed by the owners. If any person refuses to, or does not promptly accomplish the removal of, an aircraft or part thereof, said aircraft or part may be removed by the manager at the owner's or operator's expense, without liability for damage which may result in the course of or after such moving.
j.
No person shall repair an aircraft, aircraft engine, propeller or apparatus in any area of the airport other than that specifically designated for such purpose by the manager, except that minor adjustments may be done while the aircraft is on a loading ramp preparing to take off when such adjustment is necessary to prevent a delayed departure.
k.
Aircraft shall not perform run-up or prolonged engine test operations in any area that would result in a hazard or nuisance to other aircraft, persons or property.
l.
No person shall park aircraft in any area on the airport other than that prescribed by the manager.
m.
No experimental flight or ground demonstrations shall be conducted on the airport without the express approval of the manager.
n.
Any person damaging any light or fixture by operation of any aircraft, or otherwise, shall report such damage to the airport manager's office immediately and shall be fully responsible for any costs required to repair or replace the damaged facility.
o.
Aircraft parking aprons will be used exclusively for the parking and servicing of aircraft. The erection, installation or parking of any manner of obstruction, including signs, will not be permitted.
p.
No person shall interfere or tamper with any aircraft or put in motion the engine of such aircraft, or use any aircraft, aircraft parts, instruments or tools, without permission of the owner or by specific direction of the manager.
q.
All shops, garages, equipment and facilities are expressly for the conduct of the owners' or lessee's business and operations. No persons other than employees of the owner or lessee shall make use of these facilities or loiter around such premises without individual and specific permission of the owner or lessee.
r.
No persons shall enter upon the field area, control tower area, utilities and service rooms or areas or other areas as may be designated restricted, except:
1.
Persons assigned to duty therein;
2.
Persons authorized by the manager;
3.
Passengers, under appropriate supervision, entering the apron for the purpose of embarkation and debarkation.
s.
It shall be the sole responsibility of the airline operators and fixed-base operators to see that all gate chains, doors and other public safeguards are continually and conscientiously used in a manner so as to protect all persons.
t.
No person shall travel on the airport other than on the roads, walks or places provided for the particular class of traffic; nor shall any person occupy the roads or walks in such a manner as to hinder or obstruct their use. No person shall walk in a picket line as a picket or take part in any labor or other public demonstration on any part of the airport except in those places which may be specifically assigned for use by such picket lines or other public demonstrations by the manager.
u.
No person shall loiter or loaf on any part of the airport or in any building on the airport; nor shall any person come upon or use the airport except while traveling through as a passenger on an interstate bus or taxicab or while enplaning or deplaning as a passenger on an aircraft operating on the airport, after such person has been denied the use of the airport by the manager. Any person who shall refuse to comply with these applicable rules and regulations, after proper request to do so by the manager, shall be requested to leave the airport and, in the event of his failure to comply with a proper request to abide by the regulations of the air board, shall be regarded as a trespasser.
v.
All ramp equipment shall be parked and kept in a neat and orderly manner. No receptacles, chests, cases or housing shall remain on the apron or ramp area that do not fit in with the general architectural and cleanliness standards of the rest of the installation. Final approval of these items rests with the manager.
w.
No person shall engage in any business or commercial activity of any nature whatsoever on the airport except with the approval of the manager, and under such terms and conditions as may be prescribed. The soliciting of business, fares, alms or funds for any purpose on the airport, without the permission of the manager, is prohibited.
x.
Tenants, lessees and grantees shall be fully responsible for all damages to buildings, equipment, real property and appurtenances in the ownership or custody of the air board, its tenants or others caused by negligence, abuse or carelessness on the part of their employees, agents, customers, visitors, suppliers or persons with whom they may do business. All lessees on the airport shall keep the floors of the hangars, hangar areas and terminal apron and ramp areas, leased by them respectively, or used in their operations, clean and clear of oil, grease and other materials or stains except as may be provided to the contrary in any specific leases or contracts.
y.
No person shall be or become intoxicated or drunk, commit any disorderly, obscene or indecent act, or commit any act of nuisance, or conduct or engage in any form of gambling on the airport. No person shall destroy, injure, deface or disturb in any way any building, sign, equipment, marker or other structure, tree, flower, lawn or other property on the airport; or alter, make additions to or erect any building or sign or make any excavations on the airport; or willfully abandon any personal property on the airport.
(2)
Taxiing.
a.
The operation of aircraft on the airport runways and taxiways shall be in accordance with clearances and instruction received from the airport traffic control tower, ground control. Such clearances and/or instructions shall be obtained via two-way radio communications except that, in the case of radio failure, taxi clearance may be obtained as follows:
1.
Prior to departure, contact the control tower via telephone and, as traffic conditions will permit, clearance and/or instructions will be provided.
2.
Following landing, clear the runway as soon as practicable and hold short of all intersecting taxiways and runways. Appropriate clearance will be provided by the tower via light-gun signals.
b.
The taxiing or towing of aircraft within areas other than designated runways and taxiways is the sole responsibility of the persons operating the aircraft controls or operating the tow vehicle.
c.
All aircraft shall be taxied at a safe and reasonable speed and under complete control at all times, with due regard for other aircraft, persons and property.
d.
Aircraft awaiting takeoff or desiring to taxi across a runway shall hold at the runway clearance line or at least 100 feet from the runway in use until appropriate clearance is received from the tower.
e.
All persons shall use due diligence and shall not taxi or tow an aircraft behind any aircraft being taxied or run-up, or through the propeller, jet blast or turbulence from any aircraft, so as to constitute a hazard.
f.
Unless otherwise authorized, after landing and clearing the active runway all aircraft shall stop short of the first intersection they approach and contact ground control before proceeding. Pilots shall move into the exit taxiway from the active runway a sufficient distance so as to allow other aircraft to clear the runway behind them.
g.
Airline aircraft and other jet aircraft utilizing the terminal apron will approach from the south by way of the taxiway directly in front of the terminal building and depart by the taxiway to southeast.
(3)
Traffic rules.
a.
Landings and takeoffs shall be made on the runway and in the direction specified or approved by the control tower.
b.
Aircraft, after completing landing, shall clear the runway as soon as practicable at the first available taxiway. The briefing of students must wait until the aircraft is clear of runways. No 180-degree turns will be made on the runway without specific approval from the control tower.
c.
No turn shall be made after takeoff until the airport boundary has been reached and the aircraft has attained an altitude of at least 400 feet and it has been ascertained there will be no danger of collision with other aircraft. Deviation from this will be permitted only as directed by the control tower in the interest of safety or to expedite traffic.
d.
The direction of traffic operating in the airport traffic pattern shall be appropriate to the runway being used except as specifically directed by the control tower. The direction of traffic for each of the runways is as follows:
1.
Runway 6L: Left.
2.
Runway 6R: Right.
3.
Runway 16: Right.
4.
Runway 24: Left.
5.
Runway 24R: Right.
6.
Runway 34: Left.
e.
The recommended traffic pattern altitude is 800 feet for light aircraft and 1,200 feet for heavy aircraft.
f.
Aircraft intending to remain in the traffic pattern shall advise the tower prior to departure and receive appropriate instructions regarding initial turn and radio frequency to be used.
g.
Aircraft entering the traffic pattern shall exercise caution and courtesy so as not to cause aircraft already in the pattern to deviate from their course.
h.
Touch-and-go landings, overhead approaches, crosswind landings and simulated emergencies will not be permitted except when and as authorized by the control tower.
(4)
Categories of aircraft. Final determination as to the proper category designation of any aircraft shall rest with the manager. Charges applicable shall be determined according to the following classifications:
a.
Private aircraft use.
1.
Privately owned aircraft will be operated noncommercially by the owner.
2.
Private aircraft may be used by persons other than the owner provided no part of the cost of operation is received in money or otherwise by the owner for such use.
3.
Company- and corporation-owned aircraft that are operated for the free transportation of their and other personnel and/or products are classified as private aircraft and subject to the restrictions as listed under subsection (a)(4)a.2 of this section.
4.
Club aircraft must be owned and operated by a nonprofit partnership or nonprofit Florida corporation, and each club member must be a bona fide owner of a part of the aircraft or a share in the corporation. The club may not derive greater revenue from the use of its aircraft than the amount necessary for the operation, maintenance and replacement of its aircraft and will file and keep up-to-date with the manager a list of membership. An annual financial report will be filed within 30 days of the close of the club's fiscal year and the manager shall have the right to require such other reports as he deems necessary. At any time the manager has a reason to believe a club or club aircraft is being so operated that it falls under the commercial classification under this section, he shall so notify such club, and if the club fails to remedy conditions complained of the manager shall reclassify the aircraft or order specific conditions remedied. The manager shall have authority to deny the use of a club classification to any group.
b.
Commercial aircraft use. The following are classified as commercial aircraft use:
1.
Use of aircraft for rental, hire or charter.
2.
Student instruction and its kindred occupations.
3.
Any aircraft used for commercial purposes and not otherwise covered in these regulations.
c.
Certificated air carriers. The following are classified as certificated air carriers:
1.
Contract: All federally certificated air carriers holding a contract for airport usage.
2.
Noncontract: All federally certificated air carriers not covered in subsection (a)(4)c.1 of this section.
(5)
Vehicles.
a.
No person shall operate motorized equipment of any kind on the airport unless possessed of a valid state operator's license.
b.
Pedestrians and aircraft shall at all times have the right-of-way over vehicular traffic. All vehicles shall pass to the rear of taxiing aircraft.
c.
No person operating a motor vehicle on the airport shall fail to give proper signals or fail to observe the directions of posted traffic signs.
d.
No person under the influence of alcohol or narcotic drugs shall operate a motor vehicle or aircraft on the airport.
e.
No vehicle shall be operated on the airport if it is so constructed, equipped or loaded as to endanger persons or property.
f.
No person shall operate a motor vehicle without exhausts protected by screens or baffles to prevent the escape of sparks or the propagation of flame.
g.
No vehicular traffic will be permitted on, near or adjacent to the runways or taxi strips unless same is equipped with a two-way radio with ground control frequency and has been specifically cleared by the control tower; there vehicles will have to be on airport business and previously been approved by the manager.
h.
No aircraft, motor vehicle or obstruction of any kind shall be parked or permitted closer than 25 feet to the edge of any taxi strip, or within 100 feet of any runway, unless such runway or taxi strip is officially closed by the manager or airport maintenance requirements dictate otherwise.
i.
All vehicles which are authorized to operate in the aircraft facilities areas shall be painted chrome yellow or other high-visibility color, as approved by the manager, with fire and other emergency vehicles painted red. Vehicles operating in special and infrequent instances may display an approved nine-square-foot flag in lieu of the otherwise required paint requirements, upon special permission of the manager.
j.
When backing gasoline tenders and other vehicles of poor visibility in areas other than their regular parking place, a signalman must be available to guide the driver. The driver must remain in the vehicle cab and is forbidden to stand on the running board or fender while backing. Gasoline tenders will at no time be blocked or so positioned as to prevent a rapid removal of such tender.
k.
No vehicles will be authorized for runway crossing that can reasonably use a road access.
l.
No person shall park a motor vehicle for loading, unloading or any other purpose on the airport other than in the areas specifically established for parking and in the manner prescribed by signs, lines, rules and regulations, or other means. No person shall park a motor vehicle in an area requiring payment for parking thereon without paying the required parking fee, or in a manner so as to obstruct roadways, or in aircraft parking areas, or on grass areas.
m.
The manager shall have the authority to tow or otherwise move motor vehicles which are parked by their owners or operators on the airport in violation of the regulations of the airport, at the owner's or operator's expense and without liability for damage which may result in the course of such moving.
n.
Except for emergency operations, no vehicle will be operated in excess of ten miles per hour on any apron or adjacent to parked aircraft, or in excess of 30 miles per hour on any taxiway, and, in all cases, a prudent operating speed will prevail.
(6)
Fire regulations.
a.
No person shall use inflammable volatile liquids having a flash point of less than 1,100 degrees Fahrenheit in the cleaning of aircraft engines, propellers, appliances or for any other purpose, unless such operations are conducted in the open air or in a room specifically set aside for that purpose, which room must be properly fireproofed and equipped with adequate and readily accessible fire extinguishing apparatus.
b.
No person shall keep or store lubricating or waste oils in or about the hangars; provided that such material may be kept in rooms specifically designated for oil storage.
c.
Lessees shall provide suitable metal receptacles with self-closing covers for the storage of waste, rags and other rubbish. All used waste and rags or other rubbish shall be removed by the lessees daily, or in regular scheduled pickups, but not later than once each week.
d.
No person shall keep or store any inflammable liquids, gases, signal flares or other similar material in the hangars or in any building on the airport; provided that such materials may be kept in an aircraft in the proper receptacles installed in the aircraft for such purpose, or in rooms or areas specifically approved for such storage by the manager, or in safety cans approved by the National Fire Protection Association.
e.
Doping processes shall be conducted only in properly designated, fireproofed and ventilated rooms or buildings in which all illumination, wiring, heating, ventilation equipment, switches, outlets and fixtures shall be explosion-proof, spark-proof and vapor-proof, and all windows and doors shall open easily. No person shall enter or work in a dope room while doping processes are being conducted unless such person wears spark-proof shoes.
f.
Gasoline, oil and solvent drums or receptacles shall not be stored on apron and ramp areas in excess of amounts actually needed as current stock. Any material of this type that is kept in subject areas will be kept enclosed and covered in housing of a design and type that meets the approval of the manager.
g.
No fuels, oils, dopes, paints, solvents or acids shall be disposed of or dumped in drains, basins or ditches or elsewhere on the airport.
h.
All recommendations of the airport safety supervisor will be adhered to.
i.
No person shall conduct any open flame operations in any hangar or on the airport, unless specifically authorized by the manager.
j.
No person shall smoke on the airport apron, in any hangar or shop, service station area, gasoline storage area or in any building, room or place on the airport where smoking is specifically prohibited, or within 100 feet of any fueling or defueling operation.
k.
All tenants or lessees shall supply and maintain such adequate and readily accessible fire extinguishers as are approved by the National Fire Protection Association for the particular hazard involved.
(7)
Fueling operations. The following rules govern the fueling and defueling of aircraft:
a.
No aircraft shall be fueled or defueled while the engine is running or being warmed by applications of exterior heat, or while such aircraft is in a hangar or enclosed space.
b.
No person shall smoke within 100 feet of an aircraft being fueled or defueled.
c.
No person shall operate any radio transmitter or receiver or switch electrical appliances off or on in an aircraft during fueling or defueling.
d.
During refueling, the aircraft and the fuel-dispensing apparatus shall both be grounded to a point of zero electrical potential.
e.
When filling a tender from storage, two men shall be in active attendance, except that only one man shall be required if a nonlocking valve is in use on the fill pipe and the control for said valve must be continuously in the attendant's hand in order to maintain the fuel flow.
f.
No person shall use any material during fueling or defueling of an aircraft which is likely to cause a spark or be a source of ignition.
g.
Adequate fire extinguishers shall be within ready reach of all persons engaged in fueling or defueling aircraft.
h.
No person shall start the engine of any aircraft when there is any gasoline on the ground under such aircraft.
i.
Fueling hoses and equipment shall be maintained in a safe, sound and nonleaking condition and shall be approved by the National Fire Protection Association in all respects and parts.
j.
All hoses, funnels and appurtenances used in fueling and defueling operations shall be equipped with a grounding device to prevent the ignition of volatile liquids.
k.
All fueling and defueling of aircraft shall be conducted at least 50 feet from any hangar or other building.
l.
No aircraft shall be fueled or defueled while passengers are on board the aircraft unless a passenger loading ramp is in place at the cabin door of the aircraft, the aircraft door is in open position and a cabin attendant is present at or near the cabin door.
m.
Persons engaged in the fueling and draining of aircraft shall exercise care to prevent overflow of fuel. Persons responsible will take proper measures to remove any volatile liquid when it is spilled.
n.
Fuel tenders will be parked only in designated area approved by the manager.
(8)
Construction.
a.
Details of any proposed construction or modification of buildings or facilities will be submitted to the airport manager for approval prior to beginning work.
b.
FAA Form 7460-1, "Notice of Proposed Construction or Alteration," will be filed as required.
