§ 126-2. Operation of vessel.

  • (a)

    The purpose of this section is to regulate the speed and operation of vessel traffic on Volusia County waterways. The provisions of F.S. § 327 authorizes the county to adopt ordinances relating to operation of vessels. The following idle speed/no wake areas are created:

    (1)

    Stone Island Canals, more particularly described as the waterways, named and unnamed, extending from the northern shore of Lake Monroe in and through the Stone Island Planned Unit Development.

    (2)

    Osteen Bridge: All that part of the St. Johns River from shoreline to shoreline in the river from a line drawn perpendicular to the centerline of the St. Johns River, 1,100 feet northwest of the centerline of the Osteen Bridge (State Road 415) to a line drawn perpendicular to the centerline of the river at the southeast end of the fender to the centerline of the river at the southeast end of the fender system of said bridge, as depicted in sketch A.

    (3)

    Cameron Wight Park Bridge: All that part of the St. Johns River under the said bridge and north of the bridge to the location of the utility line guy wire on the east bank of the cut and 100 feet south of the bridge to the east and west banks of the cut as depicted in sketch B.

    (4)

    JJ's Fish Camp: All that part of the St. Johns River and the Cove at JJ's Fish Camp from 100 feet west of the entrance to JJ's Fish Camp to 2,000 feet easterly along the river, as depicted in sketch B.

    (5)

    C.S. Lee Park Bridge: All that part from the St. Johns River under the said bridge and from the bridge northward to Lindsey's Fish Camp and 150 feet north of Lindsey's Fish Camp and 50 feet south of the bridge all being in the main channel of the Volusia County side of the main channel, as depicted in sketch C.

    Lemon Bluff: All that part of the St. Johns River from shoreline to shoreline in the river from a line drawn perpendicular to the centerline of the St. Johns River 50 feet northeast of the Lemon Bluff boat ramp to a line drawn perpendicular to the centerline of the St. Johns River 1,200 feet southwest of Lemon Bluff boat ramp as depicted in sketch D.

    (b)

    A "25 miles per hour" boating speed zone shall be established in all that part of the St. Johns River from the southern terminus of Lemon Bluff Road to 3,800 feet southerly along the river, as depicted in sketch E.

    (c)

    Definitions:

    (1)

    Idle speed/no wake indicates a boating restricted area which has been established to protect the safety of the public. Idle speed/no wake means that a vessel cannot proceed at a speed greater than that speed which is necessary to maintain steerage way.

    (2)

    Miles per hour means speed made good over the bottom measured in statute miles.

    (3)

    Wake means all changes in the virtual height of the water's surface caused by the passage of a vessel including, but not limited to, a vessel's bow wave, stern wake, and propeller wash.

    (d)

    The sketches attached hereto [in Ordinance No. 97-20] and depicting the areas referenced above are hereby incorporated [by reference] into this section.

    (e)

    Penalty. Violations of this section are punishable as provided in section 1-7.
