§ 118-66. Liability for violations.
(a)
In any prosecution charging a violation of this article or any other state law governing the parking of a vehicle, proof that the particular vehicle described in the complaint was parked in violation of this article or state law adopted pursuant to it, together with proof that the defendant named in the complaint was at the time of such parking the registered owner of such vehicle, shall constitute in evidence a prima facie presumption that the registered owner of such vehicle was the person who parked such vehicle at the point where and for the time during which such violation occurred. The registered owner, or a person other than the registered owner who admits to being the operator of such vehicle, or a person to whom the registered owner left the care, custody or control of such vehicle, is hereby declared to be directly responsible to the county for payment of the fine for the vehicle being so parked.
(b)
A person other than the registered owner may admit to being the operator of the vehicle at the time and place of the alleged offense and may contest the allegations of the complaint. Such admission shall discharge the presumption that the registered owner was the operator at the time and place of the offense.
(c)
If the owner can prove that the vehicle was in the care, custody or control of another person, the owner is required, within a reasonable time after notification of the parking violation, to furnish to the appropriate law enforcement authorities the name and address of the person who leased, rented or otherwise had the care, custody or control of the vehicle. The owner of a vehicle is not responsible for a parking violation if the vehicle was, at the time, stolen or in the care, custody or control of some person who did not have permission of the owner to use the vehicle. The operator of a vehicle which is in his care, custody or control without the permission of the owner shall be responsible for any parking violation notice which occurs while the vehicle is in his care, custody or control.
