§ 110-123. Adjustments in costs of projects.

  • (a)

    Immediately after the completion of improvements, the final actual cost shall be determined. If the actual costs exceed the estimated costs as projected in section 110-116 and described in the tentative assessment roll pursuant to section 110-118 by more than ten percent, the council shall decide whether or not the county will absorb the excess costs, or amend the tentative assessment ordinance.

    (b)

    If the costs of the project upon which the final assessment roll is based exceeds the costs of the project upon which the tentative assessment roll was prepared by more than ten percent and the county has decided not to absorb the excess costs, then any such final assessment shall not be effective until each individual owner[s] of any unit, lot or parcel within the special assessment district has been individually notified by certified mail, return receipt requested and a public hearing held thereon.
