§ 110-101. Authorization.

  • The county council is authorized to establish special assessment districts to provide improvements and/or facilities, such improvements and/or facilities include but are not limited to:

    (1)

    Streets and roads;

    (2)

    Water supply and distribution facilities;

    (3)

    Sewage and waste collection, treatment and disposal facilities;

    (4)

    Drainage improvements and facilities;

    (5)

    Sidewalks;

    (6)

    Beach restoration and erosion control improvements and facilities; and

    (7)

    Such other or facilities which may be deemed essential to the proposed special assessment district.

    If the council in its discretion determines that a general public benefit is derived from the proposed or improvements or any portion thereof, the council shall authorize the payment for the costs of such improvement, or portion thereof generating the general public benefit, from the general funds of the county or other legally available funds.
