§ 110-43. Projected budget for operation and maintenance costs; payment of costs.

  • (a)

    The county finance department is hereby authorized and shall prepare, for the second year and each year thereafter, an annual projected budget for the operation and maintenance of a service district established under this article based on the previous year's budget of said district. The department of public works shall provide all necessary background data and information to the finance department prior to the finance department's preparation of said projected budget.

    (b)

    The annual projected cost of operating or maintaining any such service within the district shall be billed annually to the owner of any unit, lot or parcel within the district, and payable within 30 days of the date of billing. Any excess or losses of revenue from the operation and maintenance of the district shall be carried over and become a part of the next year's projected budget.

    (c)

    If the annual projected cost is not paid as specified in this article then such annual cost shall be considered to be in default; at which time the county may file and record a notice of lien against any such unit, lot or parcel which is in default as provided for by applicable law. The collection of such lien, with interest and penalties, and with reasonable attorney fees, may also be made by foreclosure in a court of equity; and it shall be lawful to join in any such bill for foreclosure any one or more units, lots or parcels, by whomsoever owned, upon which such liens have been filed and recorded. In addition to the lien which may be filed and recorded against any unit, lot or parcel as provided in this section, the county may, after five days' notice to such owner of any unit, lot or parcel, discontinue or otherwise cease to provide service to such unit.

    (d)

    The second year, and all other subsequent years, projected annual cost for the operation and maintenance of the service district shall not be a part of the assessment roll made under this article and is expressly excluded therefrom.
