§ 106-194. Jurisdiction.

  • The provisions of this article shall apply to the incorporated and unincorporated areas, and shall be enforced by the county unless the county and the appropriate municipality enter into an interlocal agreement whereby the city shall enforce the requirements of this article within the boundaries of the municipality and the city is operating a recycling program that meets the minimum standards set forth in the Florida Administrative Code. Any municipality may establish and enforce its own ordinance, provided such ordinance is equivalent to or more stringent than the provisions of this article. The provisions of this article shall not apply to an incorporated or the unincorporated area if a city or the county, respectively, submits certification to the director annually, in accordance with the State Department of Environmental Protection reporting requirements.
