§ 106-131. Collection contract required; terms and conditions.

  • Contract collectors shall enter into a solid waste collection contract in the form of a franchise with the county for the sole and exclusive right and duty to provide for the collection of all solid waste from residential improved real property in a service area. The solid waste collection contract shall establish service areas; duration of the franchise; performance and operational standards for the collector; collection schedules; requirements for vehicles, equipment, insurance and auditing of the collector; and other terms established by the council. Notwithstanding a franchise granted under this article, the county may contract with other parties to collect and dispose of all or a portion of excessive amounts of trash, debris or refuse which has accumulated by reason of any hurricane, tropical storm, freeze, natural disaster, severe disturbance, riot or other calamity. Collectors may offer to remove and dispose of the excess debris or refuse within their collection areas at a rate to be established between the director and the collectors.
